So the real question is how you get treated in the twelve or eighteen months before that happens.

The options, roughly in order

Medical payments coverage on your own auto policy

Often called MedPay. It is optional in Louisiana, commonly written in amounts like $1,000 to $10,000, and it pays regardless of fault. Most people who have it do not know they have it. Pull your declarations page and look.

Your health insurance

Use it. People hesitate because they think the at-fault driver should pay, and they end up not treating at all, which damages both their health and their case. Your health plan will likely assert a right of reimbursement out of any settlement — that is normal, it is negotiable, and it is far better than a gap in treatment.

Treatment on a medical lien

Many Louisiana providers will treat an injured person and wait for payment out of the settlement. That is a real option when there is no coverage, but the balances are not trivial and they come out of your recovery at the end. It should be a considered decision, not a default.

Med pay from a resident relative’s policy

If you live in a household with other insured vehicles, coverage may reach you even though you were not in that car. Worth checking every policy in the house.

The part nobody explains until the end

Whatever route you take, the bills, liens, and reimbursement claims get resolved out of the settlement before you see your share. That is where a case quietly loses money — a provider balance that never got negotiated, a health plan reimbursement paid in full when it did not have to be.

That negotiation is real work and it happens after the settlement number is agreed. Ask any lawyer you are considering how they handle it, and ask to see a written accounting before anything is disbursed. You should be able to see every line: what came in, what went to bills and liens, what the fee and costs were, and what is left for you.
